General Terms and Conditions of Freeways

- These General Terms and Conditions (hereinafter referred to as "GTC") of Freeways GmbH (hereinafter referred to as "Freeways") apply to all processing and handling of orders from its customers (hereinafter referred to as "customers" or "you") in online shops operated by Freeways.
- The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. By clicking the "Order now" button, you place a binding order for the goods in the shopping cart. Confirmation of receipt of the order will follow immediately after the order has been sent. A binding contract is concluded upon receipt of the order confirmation.
- We grant you a voluntary return guarantee of a total of 10 days from receipt of the goods, with the exception of reduced items, e-books, hygiene items (e.g. underwear) and customized items for which there is no right of return . If there is a right of return, you can withdraw from the contract by notifying us of the cancellation within 10 days of receipt of the goods and returning the goods to us within 10 days of declaring the cancellation, provided that the goods are complete and in their original packaging and are in an unused and undamaged condition. Timely dispatch is sufficient to meet the deadline.
- Please return the goods in their original packaging with all accessories and packaging components to the address we sent you by email.
- For further details and requirements for the valid exercise of the voluntary right of return and for returning the goods, please refer to the separate information sheet "Right of Withdrawal" (on our homepage).
- Deliveries are generally made within Germany and Switzerland. Delivery is generally carried out by Post CH AG. Articles are only delivered in normal household quantities and only to end users.
- Please note that we are not obliged to deliver the ordered goods if we have ordered the goods correctly but have not received them correctly or on time. This is provided that we are not responsible for the lack of availability of the goods and that we have informed you of this fact immediately. If the goods are subsequently unavailable, we will immediately refund any payments you have already made.
- If working days are specified as deadlines, we understand this to mean all days from Monday to Friday, with the exception of public holidays.
- We reserve the right to refuse or cancel an order if the order was generated by software, machine, crawler, spider or other automated web program or scripted behavior system or by using third party services to place the order on your behalf.
- We will cover the shipping costs for standard delivery for you.
- The prices include VAT.
- Payment must always be made by credit card, Twint or PayPal (for instant bank transfer, see the following paragraph). You pay directly in the order process by entering your payment details. After completing the order process, your chosen payment method will be charged with the actual invoice amount after deduction of any discounts, etc.
- You also have the option of paying by direct bank transfer. If you choose this payment method, you will receive an invoice for the direct bank transfer after completing the order process.
- The goods will be dispatched after receipt of payment.
- You agree to receive invoices, credit notes and other communications in electronic or paper form.
The items are delivered directly to you by Freeways partners from abroad. Customers are responsible for complying with import and customs regulations. Any resulting costs and fees are to be borne by the customer.
The statutory warranty for defects applies. Freeways expressly reserves the right to supply the customer with a defect-free replacement in the event of asserted and identified defects in the purchased item.
- The contractual and non-contractual liability of Freeways GmbH towards the customer is excluded to the extent permitted by law, except for damages caused intentionally or through gross negligence.
- Freeways’ liability for indirect damages (e.g. consequential damages) and for vicarious agents is excluded.
- Our pages contain links to other pages on the Internet. The following applies to all of these links: We expressly declare that we have no influence on the design and content of the linked pages. We expressly distance ourselves from all content on all linked third-party pages and do not adopt this content as our own. This declaration applies to all links displayed and to all content on the pages to which links lead.
- The contracting party must immediately report any damages alleged to have been caused by Freeways' actions in writing within five (5) working days of Freeways' occurrence and knowledge of the damage, otherwise the claims shall be deemed to have been forfeited.

- Freeways is not liable for damages resulting from failure or delay in performance that are caused by unforeseeable events for which Freeways, its legal representatives or its vicarious agents are not responsible (force majeure). Events of force majeure include, in particular, war, unrest, natural disasters, pandemics/epidemics, fire, power outages, official orders, lawful internal company work measures and the failure or limitation of performance of communication networks and gateways of other operators.
- Should individual provisions be invalid in whole or in part, this shall not affect the validity of these General Terms and Conditions. Invalid provisions shall be replaced by conditions that are as close as possible to the original conditions in economic terms.
- Deviations from these General Terms and Conditions are only valid if they have been agreed in writing.
- Swiss law is exclusively applicable. The provisions of the United Nations Convention on the CISG (Convention on Contracts for the International Sale of Goods), also known as the Vienna Sales Convention, are excluded. In the case of contracts with consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his or her habitual residence.
- The exclusive place of jurisdiction is the registered office of Freeways GmbH or its legal successor, except in relation to consumers, in which case the place of jurisdiction is the Swiss place of residence of the consumer.
